SCOTUS sends Joseph Clifton Smith’s capital case out of Alabama back to the 11th Circuit for further consideration of how courts analyze multiple IQ scores. Thomas and Gorsuch would have taken the case up now, so this would appear, at least, to be a temporary win for Smith.
