NY law is quirky here. Used to be that only the murder of a cop or Corrections Officer was 1st degree. They amended it to add other classes and actions. At one time, it was the only crime punishable by death in NY, though NY has no death penalty currently.
I agree that "creative" attempts to force-fit actions into the definitions of crimes they really aren't is bad governance. Charge a person with the crime the evidence proves and stop there.
