That is the only hole in all the theories so far. If it WAS in some way staged, even IF he purposefully grazed or missed him, or if he was hired to just kill him, why would he do it if he was going to die?
Maybe someone else benefit from him doing it? The payoff would benefit someone he knew? Or he thought there would be a way out?
