When these kind of discrepancies show up, I'm always wondering to what extent it's due to legislation or instructions to courts/prosecutors not considering the mandated or recommended punishments in the wider context of other punishable crimes. I could easily see such outcomes resulting from legislation being written by different people over a long period of time, if they neglect to consider other laws and punishments in the process.
