My point was that when terms in those norms are subjective and stretchable, they're going to be stretched or restricted according to the preferences of those in charge of enforcing them. If they don't like a position, they're more likely to see it as "excessive," "disingenuous," or "trolling." If they agree with it, then any arguments for it will seem reasonable. It's a bias that's almost impossible to avoid.
