While I agree that eBikes are bikes and should be treated like such, the argument that "20mph w/ throttle or 28mph w/ assist" is something that can be reached on a regular bike and is therefore ok to ride at is pretty misleading.
1. To reach those speeds regularly when you aren't on a big downhill you need to be a pretty good cyclist (I don't even without panniers, and I bike a lot for a commuter)
2. The sort of person who regularly reaches those speeds generally has a bike that weighs a small fraction of a standard eBike
