Based on yesterday's oral arguments, it looks like the Supreme Court is heading toward a 6-3 decision in favor of Tennessee. The ACLU’s best-case scenario is that the Court somehow rules this law discriminates on the basis of sex, which would send the case back to the Sixth Circuit for further analysis. But even that outcome appears highly unlikely at this point. The conservative justices asked strong, thoughtful questions and demonstrated clear skepticism of gender ideology throughout the session.
There were moments that raised concerns—such as the Court’s failure to push back on some of the unscientific terminology presented by the Biden DOJ, like "gender assigned at birth."
