Based on yesterday's oral arguments, it looks like the Supreme Court is heading toward a 6-3 decision in favor of Tennessee. The ACLU’s best-case scenario is that the Court somehow rules this law discriminates on the basis of sex, which would send the case back to the Sixth Circuit for further analysis. But even that outcome appears highly unlikely at this point. The conservative justices asked strong, thoughtful questions and demonstrated clear skepticism of gender ideology throughout the session.

There were moments that raised concerns—such as the Court’s failure to push back on some of the unscientific terminology presented by the Biden DOJ, like "gender assigned at birth." While they should have challenged this false framing, their overall approach gave us confidence that we’re headed toward the right decision. If this case is decided as expected, it will mark the beginning of a broader fight to protect children nationwide.

Children have a right to be protected from anyone who seeks to harm them, damage them, or destroy their futures. And those who push harmful practices on children are losing—this case is proof of that. But we won’t stop here. We will continue to push for a national ban on these harmful practices, starting with cutting all federal funding to the so-called "gender industry." This fight isn’t over, but a victory that once seemed impossible is now within reach.
