Most importantly it's no longer retroactive and will only apply to those who update. You can also choose a 2.5% revenue share or the runtime fee, which will be based on self-reported date.
I don't believe for a second this was tactical or overton-window shifting. They simply screwed up, hard. They could have announced this and it wouldn't have generated headline-grabbing backlash.
