Lawyers of Mastodon, a question: One of the claims in OCLC's anti-scraping case vs. Anna's Archive is an OH statutory claim for "civil recovery for criminal acts." However, OCLC doesn't allege any predicate criminal act (e.g., a state law equivalent of the CFAA) to support the claim, despite repeated references to hacking. Wouldn't expressly pleading a predicate criminal act be a necessary element of the civil claim? #LawFedi
