It's a deterministic argument that absolves men of responsibility for their action. The idea is that laws can prevent harmful behavior that's "natural," but they can't prevent the fundamental desire to engage in "natural" behaviour. Moreover, "natural" behavior must have emerged from evolution, and therefore must have some benefits or purpose

Further, if rape is "human nature," then you don't need to examine the institutions, social norms, practices, legal frameworks, and other power structures that encourage and enable it. If it's "human nature" then the rule of law is to some extent an artificial constraint on our "real" selves.
