In order to make air pollution illegal, the law has to accept that people have a property right in their own body, i.e. that they own themselves. Polluntants will then be a violation of this property right.
But if the law accepts that people own themselves, it will also have to accept that they own the fruits of their labour, i.e their money, land and wealth.
But that would also mean conceding that taxation is indeed theft and hence illegal.
So what we have instead is the law using a lot of fancy words and jargon to say that man is the property of the government who can be exploited as long as the exploiter either passes an exam or wins a popularity contest every 4-5 years.
