Most attorneys practicing today, as well as most judges, didn't have the opportunity to learn about design patents in law school. Indeed, if you graduated before 2013, you likely didn't learn about them at all, even if you took all the IP classes at your school. So most judges don't understand the Goddess test and most attorneys can't help them, unless they've taken it upon themselves to teach themselves.
